PRIVACY STATEMENT

This Privacy Statement explains how Garmin International, Inc., company incorporated in the State of Kansas in the United States (“Garmin” or “we”), collects, processes and uses the information we receive in connection with your use of this mobile application (the “App”).  You should carefully review this Privacy Statement because any information we receive via the App is subject to the terms described herein.

  1. WHAT INFORMATION GARMIN COLLECTS

Device Information:  When you install the App, we automatically collect the name and version of the App you are using as well as an unique device identifier (UDID) which is created out of the device by using a special scrambling algorithm so that it cannot be associated with a particular user’s device.  This information is stored together with a server local date and time stamp, and is used to ensure that the App functions properly, for registration, customer support, or restoring the App on your device in case you have removed the App from your device inadvertently.
  3. Location Information.  We collect the physical location of your device in order to deliver the location-based services, such as providing navigational or traffic information, points of interest and parking options. The collection and sharing of this location information can be suspended at any time by not using the location-based services within the App or by turning off your mobile device.  We may also collect information on the location, speed and direction of your mobile device (known as “traffic probe data or “floating car data”)  in order to enhance the traffic data and other content.  This information is collected in a form that does not personally identify you.   
  4. Points of Interest Feedback.  You may provide feedback on points of interest, such as restaurants, shops, gas stations, or speed cameras.  You may be able to share points of interest with third parties. Any content that you generate is collected on a voluntary basis, in a form that does not personally identify you. You should have no expectation that we will keep it private or confidential.
  5. Communications Data.  When you contact us, you may provide a variety of personal information, such as your name, mailing address, phone number, email address, and payment card information. We may fulfill your requests, communicate with you about your account or the App, send you product offers (consistent with applicable laws and your applicable choices), and provide you with customer support.   6. Other App Data.  We and our service providers may collect data about the App you have downloaded, to authenticate you as the user and to ensure that your use is consistent with the license we have granted to you. 

2. DISCLOSURE OF INFORMATION

Affiliated Entities.  We may share collected information with our affiliates worldwide for the purposes described in this Privacy Statement. You may access a list of our affiliates in our latest Annual Report on Form 10-K, which can be found at www.sec.gov. Our affiliates are required to protect Personal Information about you in a manner consistent with this Privacy Statement. Garmin International, Inc. is the party responsible for managing jointly used Personal Information.

Content Providers.  We may share information on your device’s location, speed and direction (known as “traffic probe data or “floating car data”) or points of interests on an anonymous basis with map, traffic data, or other content and electronic communications service providers to enhance the quality of their data and content.

Service Providers.  We may use service providers to help us operate our business or administer activities on our behalf. We may share your personal information with these third parties to enable them to perform the services.

Other Disclosures.  We may disclose your personal information if we have your consent to do so. We may also disclose your personal information as we believe to be necessary or appropriate: (a) under applicable law or regulation, including laws or regulations outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public authorities and law enforcement officials, including officials outside your country of residence; (d) to assist or support theft investigations involving Garmin products or property; (e) to enforce any of our terms and conditions or policies; (f) to protect our operations or those of any of our affiliates and subsidiaries; (g) to protect the rights, privacy, safety or property of Garmin, its affiliates and subsidiaries, you, or others; or (h) to permit us to pursue available remedies or limit the damages that we may sustain.

Assignment.  We may transfer information to an affiliate, a subsidiary, or a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of Garmin’s business, assets, or stock, including, without limitation, in connection with any bankruptcy or similar proceeding.

3. VOLUNTARILY SHARING YOUR LOCATION AND OTHER INFORMATION WITH OTHERS

The App may permit you to interact and share your location and other information with third parties, including social networks such as Glympse and Foursquare. Use caution when interacting with these features. Such interactions are governed by the privacy policy of the company providing the feature, and we are not responsible for the data practices of such other companies (including, without limitation, as applicable, Glympse, Foursquare, Facebook, Apple, Google, Microsoft, RIM, or any other app, social media platform, or wireless service provider).

4. LINKS, THIRD PARTY APPS, AND THIRD PARTIES' PRIVACY PRACTICES

The App may contain links to services that are not operated by Garmin. We are not responsible for their privacy practices, and we recommend that you review their privacy policies.

5. SECURITY

We take reasonable measures to help protect against loss, misuse, unauthorized access, and unauthorized disclosure or alteration of the personal information under our control. If you believe that your interaction with us is no longer secure, please immediately notify us in accordance with Paragraph 8 below.

6. USE OF THE APP BY CHILDREN

The App is not directed to children, and we request that such individuals not provide personal information to us.

7. RETENTION OF PERSONAL INFORMATION

We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Statement unless a longer retention period is required.

8. REVIEWING/CORRECTING/UPDATING/DELETING INFORMATION; DATA INTEGRITY

We take reasonable steps to ensure that the personal information we collect from you is accurate, complete, and current. You may request access and request that inaccurate personal information be updated. You may also request that your personal information be deleted. For your protection, we may only implement requests with respect to the personal information associated with the email address that you use to send us your request, and we may verify your identity. We may decline to process requests that jeopardize the privacy of others, are extremely impractical, or would cause us to take any action that is not permissible under applicable laws. We may retain certain information for recordkeeping purposes, and there may also be residual information that will remain in our databases and other records, which will not be removed.
